The Portfolio Committee on Justice and Correctional Services is considering amendments to the Cannabis for Private Purposes Bill and asked for public comments

Cannabis (in all forms) is currently illegal for persons under 18 years of age. The committee invites you to comment on alternative solutions by which to address the issue of prohibited use, possession and cultivation of, or dealing in, cannabis by persons younger than 18 years.

    Objective of the Amendment 

    The Portfolio Committee on Justice and Correctional Services is currently considering amendments to the Cannabis for Private Purposes Bill [B19 – 2020]. The committee invites you to make written submissions on alternative solutions by which to address the issue of the prohibited use, possession and cultivation of, or dealing in, cannabis by children (persons younger than 18 years), with due regard to the best interest of the child.

    The alternative methods proposed by the Committee are that the child must be dealt with outside of the criminal justice system, in terms of—

      1. The Children’s Act, 2005 (Act No. 38 of 2005);
      2. The Prevention of and Treatment from Substance Abuse Act, 2008 (Act No. 70 of 2008); or
      3. Any other relevant legislation.
