I support the infrastructure norms for teacher development facilities, including access for people with disabilities, backup power and the end of pit toilets. I do not fully support the rest of the regulations, because they move power away from parents and school governing bodies and towards provincial officials.

1. Dissolving SGBs. School governing bodies are elected by parents and are the main way parents take part in their children's schooling. The Head of Department should only be able to dissolve an SGB for proven maladministration, after written notice setting out the reasons, a fair chance to fix the problem, and access to an independent appeal. Any interim body should serve for a short, fixed period until new elections, which parents should run.

2. Section 38A approvals. Many schools use money raised by parents to pay educators for extra classes, coaching and weekend work. A wait of up to three months for HoD approval will disrupt this. If the HoD has not responded within 30 days, the application should be treated as approved.

3. E-voting. Electronic voting in SGB elections must be optional, with a paper ballot always available, proper voter verification and an audit trail. Many parents do not have reliable data or smartphones.

I remain concerned that the BELA Act as a whole moves decisions on admission and language policy from parents and governing bodies to the HoD. These regulations should not widen that shift any further. Parents, not officials, have the primary responsibility for their children's education.

Totally disagree with Section 38A -- it is very important that school that offer many additional activities which are so important to developing the character, employability, creativity and social skills so important for the success of the young people - and for all of us and the country that there is emphasis on these non-curriculum activities. It is unfair to expect staff that are employed primarily to teach in class, do all the marking and then to provide all the additional time needed to ensure the success of the graduates.
Please leave the schools to be able to pay for these additional service.
It is not appropriate to give the Province powers to decide what the SDAs want to raise money for and if they decide to support in the school in order to improve the capability of the graduates to be engaged and successful graduates.

I object to the BELA Act and the further centralisation of decision-making authority over education. South Africa’s education system already faces serious challenges, and I do not believe that transferring greater authority away from parents, school governing bodies and individual school communities to government departments is the appropriate solution.

Greater focus should instead be placed on improving the quality, accountability and performance of existing public schools, while preserving meaningful parental choice and the ability of successful school communities to participate in decisions affecting their children’s education.

I therefore support an education system that empowers parents and communities, encourages accountability and diversity, and focuses government resources on improving educational outcomes rather than increasing centralised control and standardisation.

This reads as soviet era control, and has NO place in a democratic country and should be scrapped on the spot. This again is gross overreach from a government that cannot or wont do the basics, and wants to interfere with what is still working in spite of their actions.

Unfortunately this Act creates a bureaucratic burden on teachers and learners. Some autonomy for SGBs is the point of SGBs in the first place.

School function will regress when a decision cannot be made timeously.
