I strongly oppose the proposed regulations. They introduce dangerous overreach and undermine constitutional protections. Sentencing based on emotional testimony rather than objective facts risks arbitrary justice. The creation of a “hate” database that records political and religious views is a clear violation of privacy and freedom of belief. Furthermore, the surveillance of social media activity—especially reposts—threatens free expression and sets a chilling precedent for digital censorship. These measures are incompatible with a democratic society and must be withdrawn.

I strongly oppose these draft regulations in their entirety. They represent a blatant attack on free speech, privacy, and justice by turning sentencing into an emotional lottery based on victims' feelings rather than objective facts, building a chilling 'hate' database on mere accusations (including political views), and enabling invasive surveillance of social media sharing. This is authoritarian overreach that threatens South Africa's constitutional freedoms—reject it completely!

This is a gagging order...in the form of a law.
Freedom of speech in our Constitution will be raped and can be declared nil and void.
It has become like the USA under Donald Trump..just a stage up.

This law is only meant to push political agendas and has no fairness to it. It also intrudes on privacy. also in short just another law that has been made , to Manny laws on another law on another law in short the one in wrong doing has more doors to escape and the one that was actually the victim was punished corrupted system states more corrupted with just another law.

A good idea on paper, but this will get abused like our taxes. This country has lost the plot when it comes to equality and it's grip on reality. If you want to be offended, enjoy it. I don't care.

This law is only meant to push political agendas and has no fairness to it. It also intrudes on privacy. Based on the same types of laws being passed and implemented in the UK it has already been shown that these types of laws has no purpose other than to silence free speech and push political agendas towards totaliarism. No law of this kind should ever be allowed in a democracy with free speech.

Sentencing by Emotion (The “Lottery”): Prosecutors are required to submit a Victim Impact Statement to the court to “aggravate” sentencing. This introduces a subjective standard where your punishment may be determined by the emotional resilience of the accuser rather than the facts of the crime.
The “Hate” Database: The SAPS must record specific personal details of every accused person—including their political, religious, or social leanings—to build a national database of offenders.
Social Media Surveillance: Specific police forms (Form 3) have been created to track the “distribution” of electronic communications, targeting those who forward or repost content.

The requirement for a Victim Impact Statement to “aggravate” sentencing means your punishment could be determined by the emotional resilience of the accuser rather than the objective facts of the crime.
Victim Impact Statement” to the court to aggravate sentencing.
The Trap is in “Aggravation,” not “Guilt”.
To find you guilty, the court should look at your intent not at the Victim Impact Statement.
If the “severity” of the crime is measured by the victim’s feelings (via the VIS), you strictly argue that sentencing becomes a lottery.

Free speech is my right. I can not offend anyone. They can only take offence, which is on them.

Too subjective -- oversensitive people might misunderstand what is being said to them with the best intentions in the world, and overreact. This also puts "freedom of speech" at risk, when it is the foundation of every functioning democracy.
