      3 of 2000)

[1. The Core Crisis at a Glance](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1738150189952-44103674-e29d31d9-c3be5520-25434195-6b91)

For more than two years, residents of Christoburg and Erasmia living in close proximity(
from 800 metres) to the PPC Laudium Quarry have been subjected to continuous environmental
violations, structural damage, and acute sleep disruption:

    - _Structural Wall & Foundation Fractures:_ Heavy daytime opencast dynamite
blasting sends ground vibrations directly into residential properties, causing
jagged vertical wall cracks, perimeter boundary shears, and foundational slab
ruptures that permit sub-surface damp ingress.
    - _Toxic Dust Emissions & Air Pollution:_ Continuous rock crushing and unmitigated
quarry vehicle movement generate fine particulate matter (PM10 / PM2.5) that
blankets residential erfs. Families are forced to live behind permanently
sealed windows and run air conditioning constantly, while suffering documented
      respiratory and allergy flare-ups.
    - _Unregulated Night & Weekend Noise:_ Industrial rock crushers, drilling rigs,
and heavy machinery operate outside standard daytime municipal hours—running
around midnight and during early morning hours—causing chronic sleep deprivation.

[3. The Paper Trail: Corporate Deflection & Withheld Reports](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1738150854013-bb98f5fb-7d0931d9-c3be5520-25434195-6b91)

Official correspondence and tracking records expose a clear sequence of evasion:

 1. a. _The “VIBRO Bricks” Deflection:_ When residents first raised urgent concerns regarding
ground shudder and odd-hour plant noise in late 2024, PPC senior management claimed
the disturbances were caused by the neighbouring VIBRO brick factory. Direct investigation
on 14 July 2025 disproved this, confirming that the noise and vibrations occurred
well outside VIBRO’s operational hours and originated from PPC’s crushers.
     b. _The Unfulfilled Commitments of 17 September 2025:_ Following formal legal letters
from Walter Sibeko (LAW FOR ALL), PPC General Manager Arthur Ndindani issued formal
written undertakings (Ref: C6748-7-2025) promising to provide independent monitoring
reports for dust, noise, and vibration, continue accredited assessments, and convene
a technical site meeting. Over a year later, PPC has refused to disclose a single
        report.
     c. _The Legally Baseless “60-Year Longevity” Defence:_ PPC management claimed that
because the quarry has existed for over 60 years and the resident “only recently
took up residence,” ambient impacts were “foreseeable” and liability was rejected.
Under South African constitutional and property law, “coming to a nuisance” is
not a valid legal defence; historical operation does not grant immunity from NEMA
Section 28 Duty of Care or modern environmental authorisations.
     d. _Five Statutory Reports Withheld from the Public:_ PPC has failed to produce its
approved Mine Works Programme (MWP), current Environmental Management Programme
report (EMPr), Environmental Impact Assessment (EIA), independent scientific impact
studies, or accredited dust fallout and seismograph test logs.

[4. The Civic Demands on the Table](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1738151172108-10076802-4d0031d9-c3be5520-25434195-6b91)

Submissions lodged through this campaign demand that authorities take immediate
administrative action under PAJA and NEMA:

 1. a. _Immediate DMRE Section 54 Stoppage Order:_ The Principal Inspector of Mines must
halt all blasting and night-time plant crushing until structural safety and vibration
        limits are independently verified.
     b. _City of Tshwane Section 31L Compliance Notice:_ The Municipality must enforce
an immediate curfew restricting all noisy machinery, drilling, and crushing strictly
        to weekday daytime hours (07:00–17:00).
     c. _Public Disclosure of All Environmental Audits:_ PPC must immediately release
its approved EMPr, Atmospheric Emission Licence (AEL), and accredited dust/noise/
vibration test records to the public.
     d. _Independent Engineering Assessment:_ A comprehensive structural engineering survey
of all affected homes in Christoburg and Erasmia must be commissioned at PPC’s
        expense to establish remediation liabilities.

[5. Why Use Dear South Africa Instead of a Petition?](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1793106890864-98b4ec2b-83e8)

    - _Petitions Carry Minimal Legal Standing:_ Government departments routinely
log traditional petitions signed by thousands of people as a single collective
objection, easily acknowledged and dismissed with one letter.
    - _DearSA Runs on an Individual Statutory Mandate:_ Every comment submitted
via this portal generates an authenticated, standalone legal representation
under PAJA. Submissions are delivered directly to the designated inboxes of
the DMRE Inspectorate, the City of Tshwane Environmental Health Directorate,
PPC Executive Directors, and the Presidency, legally obligating organs of
state to record and evaluate each citizen’s input.
    - _Court-Ready Evidentiary Record:_ At campaign close, DearSA compiles all qualitative
input and demographic data into an audited Public Participation Report to
support subsequent legal review or High Court interdict proceedings if regulators
      fail to act.

### _Questions and answers_

[Where is the PPC Laudium Quarry located?](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1763554389233-fdb8fee6-6da45520-25434195-6b91)

The quarry is situated along Pierre Van Reyneveld Road, Laudium, Pretoria (GPS Coordinates:-
25.792680740638108, 28.080661143130605), directly bordering the residential suburbs
of Christoburg and Erasmia, and adjacent to Itireleng.

[What specific statutory reports are residents demanding?](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1763554389265-aa09206a-77665520-25434195-6b91)

Residents and legal counsel have formally requested five essential compliance documents:

 1. a. The approved Mine Works Programme (MWP).
     b. The current Environmental Management Programme / Plan (EMPr).
     c. The Environmental Impact Assessment (EIA) Report.
     d. Independent scientific impact studies evaluating current operational thresholds.
     e. All third-party accredited dust fall, noise, and seismic vibration monitoring
        reports since January 2024.

[How does commenting via Dear South Africa differ from signing a petition?](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1763554389298-fbc55a3c-817c5520-25434195-6b91)

In South African administrative law, an online petition containing thousands of
names is legally logged as a single, collective representation. Government tribunals
and mining inspectorates can dismiss it with a single acknowledgement.

Conversely, Dear South Africa enforces an individual statutory legal mandate. Every
submission entered through this platform is processed as an independent, authenticated
administrative representation delivered directly to the inboxes of the DMRE Gauteng
Principal Inspector, the City of Tshwane Environmental Inspectorate, PPC Executive
Directors, and the Presidency. This legally obligates authorities under the Promotion
of Administrative Justice Act (PAJA) to record and consider every single submission.

[What happens once this campaign concludes?](https://dearsouthafrica.co.za/ppc-laudium-quarry/summary/#1771840733358-e4b2d08e-b2264195-6b91)

DearSA compiles, authenticates, and audits all qualitative representations and demographic
data into a formal Public Participation Report. This report is formally delivered
to the Minister of Mineral and Petroleum Resources, the City of Tshwane Council,
and the Presidency. It establishes an unassailable, court-ready administrative record
that civil society and community legal counsel can rely on in High Court review
proceedings or Section 28 NEMA emergency interdict applications.

### Cape Independence Party

**CAPEXIT Party strongly opposes the Business Licensing Bill in its entirety on
all points:**

**Preferential licensing**
The Bill explicitly empowers the Minister to grant licences
on a “preferential” basis and to impose conditions that advance “historically disadvantaged
individuals” or other designated groups. This is nothing less than state-sanctioned
racial and ideological discrimination dressed up as transformation policy.

CAPEXIT rejects the notion that the state has any legitimate role in deciding which
racial or social group may or may not operate a business. Such preferential licensing
will:

    - Reintroduce apartheid-era economic controls under a new ideological banner;
    - Create a cronyist system where access to markets is determined by political
connections and demographic criteria rather than merit, innovation or consumer
      demand;
    - Discourage both domestic and foreign investment, as investors will rightly
fear that their businesses can be denied licences or subjected to arbitrary
conditions on racial or political grounds.

No free society licenses businesses on the basis of the owner’s skin colour or historical
narrative. This clause alone renders the entire Bill unconstitutional and morally
indefensible.

**Principles of business licensing**
The Bill fails to articulate any coherent,
objective, or proportionate principle for requiring a general business licence in
the first place. Instead, it presumes that every enterprise – from a street vendor
to a multinational corporation – must seek prior permission from the state simply
to exist and trade.

This reverses the fundamental principle of a free economy: citizens should be free
to engage in lawful economic activity without state permission unless there is a
clear, evidence-based justification (e.g. public health, safety or environmental
protection).

The Bill provides no such justification. It is a blanket assault on economic freedom,
reminiscent of the licence-permit raj that crippled India’s economy for decades.
Requiring a general “business licence” in addition to existing sector-specific permits(
liquor, health, zoning, etc.) serves no legitimate public purpose – only the purpose
of expanding state control and creating new opportunities for rent-seeking and corruption.

**Powers of inspectors**
The Bill grants inspectors extraordinarily broad and invasive
powers, including warrantless entry into private premises, seizure of documents
and goods, and the ability to close businesses on the spot. These powers are ripe
for abuse and will be weaponised against political opponents, non-compliant businesses,
and any entrepreneur who refuses to pay bribes.

In a country already plagued by corruption scandals, handing unelected officials
the power to enter and shut down businesses without judicial oversight is an open
invitation to extortion. Small businesses, spaza shops, and informal traders – many
of them immigrant-owned – will be particularly vulnerable to harassment and shakedowns.
Far from promoting transformation, this will simply create a new class of “licence
inspectors” who enrich themselves at the expense of the poor.

**More red tape**
South Africa already ranks poorly on the World Bank’s Ease of
Doing Business index, largely because of regulatory overreach. This Bill adds yet
another layer of costly, time-consuming bureaucracy on top of SARS registration,
municipal permits, B-BBEE compliance, UIF, COIDA, sector SETA requirements, and
dozens of other licences.

The compliance costs – application fees, mandatory consultations, endless paperwork,
and the risk of arbitrary refusal – will crush startups and force thousands of small
businesses to close or remain informal. Jobs will be lost, investment will flee,
and the tax base will shrink. The Western Cape, which has consistently outperformed
the rest of South Africa precisely because of lighter and more efficient regulation,
will see its competitive advantage deliberately sabotaged by Pretoria.

**Conclusion**
The Business Licensing Bill is not reform – it is economic sabotage.
It centralises power in the hands of an already overreaching and underperforming
national government, reintroduces racial criteria into commerce, and erects new
barriers to entrepreneurship at a time when South Africa desperately needs growth
and jobs.

CAPEXIT calls for the complete withdrawal of this Bill. The people of the Western
Cape, and indeed all South Africans who believe in freedom, will not accept a return
to a permit-based economy controlled by bureaucrats and political gatekeepers.

For a free, prosperous, and non-racial future, this Bill must be rejected in its
entirety.
