### Residents across Christoburg, Erasmia, and neighbouring communities bordering the PPC Laudium Quarry face an escalating environmental, structural, and health emergency.

For over two years, heavy blasting operations, continuous industrial aggregate crushing,
and unregulated dust fallout have severely compromised residential properties and
public health. Homes situated within 800 metres of the quarry suffer severe foundation
fractures, cracking boundary walls, and damp ingress. Meanwhile, thick dust plumes
penetrate dwellings daily, aggravating acute respiratory conditions and requiring
continuous closed-window air filtration. Intrusive industrial noise and ground vibrations
from plant machinery regularly run late at night and into early morning hours, causing
chronic sleep deprivation.

Despite formal attorney letters, on-site inspections, and written undertakings by
PPC management in September 2025 to disclose independent environmental monitoring
reports, PPC has failed to produce statutory compliance audits, EIA documentation,
or independent test records. The company has systematically deflected responsibility,
citing historic operation and attempting to attribute local vibrations to third-
party operations.

Because regulatory inspectorates and corporate management have failed to remediate
these violations, the matter has been escalated to the Presidency.

Online petitions do not work. Government departments and mining tribunals routinely
treat petitions with thousands of signatures as a single collective objection. This
is NOT a petition.

Dear South Africa operates on an individual statutory mandate model. Commenting
via this portal generates an authenticated, standalone legal representation routed
directly to the DMRE Chief Inspector of Mines, the City of Tshwane Environmental
Inspectorate, the Presidency, and PPC’s executive desk under PAJA and NEMA.

### _Where Do You Stand?_

🔴 I OBJECT to PPC Laudium Quarry’s ongoing operations in their current unmitigated
form
_(Demands immediate regulatory enforcement and compliance sanctions: Rejects
heavy blasting that causes structural foundation and wall cracking in neighbouring
homes; opposes unregulated fugitive dust fallout causing documented respiratory
illness; rejects industrial rock crushing and drilling during late night hours and
weekends; and demands immediate DMRE Section 54 Stoppage Orders, City of Tshwane
Section 31L Compliance Notices, and the public disclosure of all withheld EMPr,
AEL, and scientific monitoring records)._

🟢 I SUPPORT PPC Laudium Quarry’s operations as currently conducted
 _(Backs an
established strategic aggregate producer: Supports a vital local economic operation
supplying building aggregates to the Tshwane metro for over 60 years; accepts PPC’s
position that ambient dust, noise, and seismic vibrations remain within statutory
thresholds; and agrees that operational moratoria or compensation liabilities should
not be imposed without conclusive, independent scientific and medical causation)._

### _Participant Reference Guide: Top Concerns Explained_

Use this reference guide to understand the specific issues affecting our community
before casting your vote and submitting your comments. When participating via the
DearSA portal, you can select one of these concern categories, or choose “All of
the above” to generate a comprehensive, legally binding submission under PAJA and
NEMA.

[1. Structural Damage & Foundation Fractures (Blasting & Heavy Vibrations)](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1770131112026-5a70eb21-10f15d6a-e1cd1d69-949086db-d4dd553e-243f)

    - _The Core Issue:_
Heavy opencast blasting and the continuous operation of
industrial rock crushers produce low-frequency ground vibrations and seismic
shockwaves that travel directly into adjacent residential neighbourhoods.
Homes situated within 800 metres of the quarry (particularly along Senorita
Street and Van Der Wall Street in Christoburg and Erasmia) suffer from widening
vertical and stair-step wall cracks, fractured perimeter boundary walls, and
ruptured concrete foundation slabs. In documented cases, foundational fracturing
has allowed underground water ingress, damaging flooring and compromising
      structural integrity.
    - _The Evidence:_
       * Logged structural defect reports and photographic evidence from Christoburg
         homeowners documenting progressive foundation separation.
       * Forced replacement of domestic carpets with waterproof vinyl flooring due
to sub-slab damp penetration caused by blasting fractures.
       * Seismic shock and structural crack progression matching daytime opencast
         blasting events.
    - _Statutory Grounding:_
       * _Mine Health and Safety Act 29 of 1996 (MHSA):_ Mandatory Codes of Practice(
COP) governing surface blasting, peak particle velocity (PPV) limits, and
vibration thresholds to protect surrounding structures.
       * _NEMA Section 28 (Act 107 of 1998):_ Strict Duty of Care requiring commercial
operators to prevent and remediate physical damage and environmental harm.
       * _Common-Law Nuisance & Property Rights:_ Unreasonable interference with
domestic property rights and physical damage to private immoveable property.

_Suggested Wording for Your Submission:_

_“I object to the ongoing heavy blasting operations and unmitigated plant vibrations
emanating from PPC Laudium Quarry. These seismic disturbances exceed safe domestic
thresholds, causing documented structural fractures to foundation slabs, load-bearing
walls, and boundary structures across Christoburg and Erasmia. I demand that the
DMRE Principal Inspector of Mines issue an immediate MHSA Section 54 Stoppage Directive
on blasting until an independent structural engineering audit is conducted at PPC’s
expense to inspect, record, and remediate all private property damage.”_

[2. Severe Air Pollution & Toxic Particulate Dust Fallout](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1770131112043-0e75ef86-4b6c5d6a-e1cd1d69-949086db-d4dd553e-243f)

    - _The Core Issue:_
Quarry excavation, blasting plumes, internal heavy-haul
vehicle movements, and aggregate crushing generate massive, continuous plumes
of fine fugitive dust and particulate matter ($PM_{10}$ and $PM_{2.5}$). Because
active suppression measures (water spraying, chemical dust binding, windbreaks)
are inadequate, prevailing winds carry dense, toxic particulate clouds directly
      into residential areas.
    - _The Evidence:_
       * Documented daily dust fallout coating rooftops, solar panel arrays, verandas,
and vehicles in Christoburg and Erasmia.
       * Severe domestic disruption: residents are unable to open windows or use
natural ventilation, forcing households to run continuous air conditioning
and indoor air filtration systems at immense electrical expense.
       * Documented respiratory complications, chronic asthma exacerbations, and
severe allergy flare-ups among affected families, directly undermining
         Section 24 constitutional health guarantees.
    - _Statutory Grounding:_
       * _National Environmental Management: Air Quality Act 39 of 2004 (NEMAQA):_
National Dust Control Regulations governing permissible dust fallout rates
in residential zones (strict limit of 600mg/m2/day).
       * _Section 24(a) of the Constitution:_ The fundamental, non-negotiable right
of every person to an environment that is not harmful to their health or
         well-being.
       * _NEMA Section 28:_ Legal duty on PPC management to take all reasonable
measures to eliminate airborne pollutant emissions impacting neighbouring
         communities.

_Suggested Wording for Your Submission:_

_“The fugitive dust fallout and toxic particulate emissions generated by PPC Laudium
Quarry represent a severe violation of NEMAQA National Dust Control Regulations
and my Section 24 constitutional rights. Residents are subjected to continuous airborne
pollution that forces families to live behind permanently sealed windows and causes
documented respiratory illness. I demand that the City of Tshwane Air Quality Directorate
and DMRE enforce immediate, mandatory dust-suppression audits and install public,
continuous real-time air monitoring stations on the quarry boundary.”_

[3. Unlawful Night & Weekend Noise Disturbances](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1770131281853-5866958a-b51c5d6a-e1cd1d69-949086db-d4dd553e-243f)

    - _The Core Issue:_
While opencast blasting is generally conducted during daytime
hours, heavy primary/secondary rock crushing, earthmoving equipment, vehicle
sirens, reverse alarms, and drill rigs routinely operate late into the evening,
around midnight, during the early hours of the morning, and over weekends.
These low-frequency industrial sounds penetrate residential homes, completely
shattering the quiet, domestic character of the surrounding suburbs.
    - _The Evidence:_
       * Audio recordings capturing high-decibel drilling, crushing plant mechanics,
and reverse warning sirens operating between 23:00 and 04:00.
       * Chronic sleep deprivation reported by families, resulting in severe psychological
         stress and impaired workplace performance.
       * Failure by the mine to install effective physical acoustic sound barriers,
acoustic berms, or restrict heavy machinery processing to standard daylight
         municipal operating hours.
    - _Statutory Grounding:_
       * _Gauteng Noise Control Regulations (Notice 5479 of 1999):_ Strict prohibition
against generating a “disturbing noise” or “noise nuisance” exceeding ambient
residential limits (typically 35dBA to 45dBA at night).
       * _City of Tshwane Metropolitan Municipality Noise Control By-Laws:_ Mandatory
operational restrictions on industrial and commercial machinery adjoining
         residential areas.
       * _MHSA Code of Practice:_ Operational obligations to prevent occupational
noise from spilling over and constituting an environmental hazard to bordering
         civilian properties.

_Suggested Wording for Your Submission:_

_“I object to the intolerable noise pollution caused by PPC’s crushers, drill rigs,
and heavy plant machinery running during the night and on weekends. This excessive
industrial noise far exceeds legal thresholds set out in the Gauteng Noise Control
Regulations and Tshwane municipal by-laws, causing chronic sleep deprivation and
psychological distress. I demand an immediate, legally enforceable operational curfew
restricting all aggregate crushing, drilling, and processing to standard weekday
business hours (07:00 to 17:00).” _

[4. Concealment of Statutory Reports & Breach of Undertakings](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1770131323251-266a4851-6c9c5d6a-e1cd1d69-949086db-d4dd553e-243f)

    - _The Core Issue:_
PPC claims to operate within statutory thresholds and asserts
that regular audits prove its compliance. However, when community legal counsel
formally requested these records, PPC management systematically withheld them.
On 17 September 2025, PPC General Management formally committed in writing(
Ref: C6748-7-2025) to provide independent monitoring reports and convene technical
site meetings with experts. More than a year later, PPC has refused to disclose
      a single report.
    - _The Evidence:_
       * Formal written letter from PPC GM Arthur Ndindani dated 17 September 2025
promising disclosure of independent dust, noise, and vibration reports.
       * Attorney follow-up notices dated 14 November 2025 and 23 January 2026 confirming
that PPC failed and refused to provide the promised records.
       * Total suppression of the 5 key statutory compliance documents requested
         by the community:
          1. Approved Mine Works Programme (MWP).
          2. Environmental Management Programme report (EMPr).
          3. Environmental Impact Assessment (EIA).
          4. Independent scientific impact evaluations.
          5. Certified dust bucket fallout and seismograph vibration test reports.
    - _Statutory Grounding:_
       * _Promotion of Administrative Justice Act 3 of 2000 (PAJA):_ Principle of
lawful, reasonable, and procedurally fair administrative action.
       * _Section 32 of the Constitution & PAIA (Act 2 of 2000)_: Right of access
to information held by commercial entities where that information is required
to protect constitutional rights (such as health, safety, and property).

_Suggested Wording for Your Submission:_

_“PPC’s refusal to disclose its independent environmental and vibration monitoring
records—despite giving explicit written undertakings on 17 September 2025—demonstrates
bad faith and administrative concealment. A company operating lawfully within environmental
limits has no reason to hide its monitoring data. I demand that the DMRE and City
of Tshwane compel PPC to immediately publish its full EMPr, AEL, and all third-party
dust, noise, and vibration test logs in the public domain for civic review.” _

[5. Corporate Deflection & The Unlawful "Prior Settlement" Pretext](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1777463528421-99209505-be9a1d69-949086db-d4dd553e-243f)

    - _The Core Issue:_
Rather than mitigating its environmental harm, PPC senior
management has repeatedly sought to evade liability through deflection and
      procedural pretexts:
       1. _Third-Party Blame:_ Management attempted to divert resident complaints by
claiming disturbances were caused by the neighbouring VIBRO brick manufacturing
plant. Direct investigation on 14 July 2025 disproved this, confirming disturbances
          occurred outside VIBRO’s operating hours.
       2. _The “60-Year Operating Pretext”:_ PPC claimed in official correspondence
that because the quarry has existed for over 60 years and the resident “only
recently took up residence,” ambient impacts were “foreseeable” and liability
          was rejected.
    - _The Legal Reality:_
In South African environmental and property jurisprudence,“
coming to a nuisance” is not a valid legal defence. Historical longevity does
not grant an industrial operator a perpetual licence to pollute, crack neighbouring
properties, or violate modern environmental legislation. Every mining right
holder is bound to comply with the Constitution (1996), NEMA (1998), NEMAQA(
2004), and the MHSA (1996), irrespective of how long the quarry has operated.
    - _Statutory Grounding:_
       * Constitutional Supremacy (Section 2): Any conduct or historical commercial
practice inconsistent with constitutional rights is invalid.
       * NEMA Section 28(1): The Duty of Care applies retrospectively and continuously
to any person who causes, has caused, or may cause significant pollution
         or degradation.

_Suggested Wording for Your Submission:_

_“I reject PPC’s assertion that its 60-year operational history or the date a resident
moved into the area exempts the mine from environmental compliance. The ‘coming
to a nuisance’ doctrine has no standing in South African constitutional and environmental
law. PPC is strictly bound by Section 28 of NEMA and current statutory air and noise
limits. The mine’s repeated attempts to deflect blame onto neighbouring businesses
such as VIBRO further confirm a failure to take accountability for its operational
impacts.” _

[6. Regulatory Abdication by the DMRE & City of Tshwane](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1777463564023-1723eae7-45f61d69-949086db-d4dd553e-243f)

    - _The Core Issue:_
Despite repeated attorney letters, registered NEMA complaints,
and on-site municipal inspections, the statutory regulators—specifically the
Department of Mineral Resources and Energy (DMRE) Mine Health and Safety Inspectorate
and the City of Tshwane Environmental Health Directorate—have failed to exercise
their statutory enforcement mandates. This ongoing regulatory failure has
forced the community to escalate the matter directly to the Presidency of
      the Republic of South Africa.
    - _The Failure:_
       * No Section 54 Stoppage Orders issued under the MHSA despite severe private
         structural property damage.
       * No Section 31L Compliance Notices issued under NEMA by Environmental Management
         Inspectors (“Green Scorpions”).
       * Lack of independent, state-supervised seismograph and air sampling to verify
         PPC’s uncorroborated internal compliance claims.
    - _Statutory Grounding:_
       * _Section 195 of the Constitution:_ Basic values and principles governing
public administration, including responsiveness, transparency, and accountability.
       * _Promotion of Administrative Justice Act 3 of 2000 (PAJA):_ Failure by
an organ of state to take a mandatory statutory decision where there is
         an ongoing unlawful situation.

_Suggested Wording for Your Submission:_

_“The failure of the DMRE Principal Inspector of Mines (Gauteng) and the City of
Tshwane Environmental Inspectorate to take decisive regulatory action constitutes
administrative abdication under PAJA. Regulators cannot act as passive observers
while mining operations violate environmental authorizations and constitutional
rights. I demand that the DMRE and City of Tshwane immediately conduct unannounced,
independent compliance audits and issue formal compliance notices to safeguard our
community.” _

### _Perspectives: What is the debate?_

[What PPC Management Argues:](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1770892117175-dfc38055-c8385d6a-e1cd1d69-949086db-d4dd553e-243f)

    - _Statutory Compliance: _
PPC maintains its mining activities operate within
limits under the Mine Health and Safety Act (MHSA), NEMA, and statutory permits,
claiming regular internal and external audits confirm compliance.
    - _Independent Monitoring: _
The mine states an accredited consultant was appointed
to monitor dust, noise, and vibration, and that dust buckets installed since
February 2025 have not exceeded statutory thresholds.
    - _Historical Land Use: _
Management argues the quarry has operated lawfully
for over 60 years and supplies essential building aggregates across the City
      of Tshwane economic corridor.
    - _Causation: _
PPC rejects liability for residential respiratory ailments
and structural wall cracks, claiming claimants have not established a direct
scientific and medical causal link to quarry operations.

[What Affected Residents & Opponents Argue:](https://dearsouthafrica.co.za/ppc-laudium-quarry/#1770892117205-3c7c32e1-ce3d5d6a-e1cd1d69-949086db-d4dd553e-243f)

    - _Withholding Evidence: _
If PPC’s independent monitoring demonstrates full
compliance, management would have disclosed the reports as promised on 17
September 2025 instead of withholding them from affected residents.
    - _Physical Damage Speaks for Itself (Res Ipsa Loquitur):_
       Clear structural
fractures, cracked foundations, and damp ingress documented across Senorita
Street homes directly mirror quarry blasting patterns and seismic blast timings.
    - _Unacceptable Operational Hours: _
Lawful quarrying does not entitle an operator
to run aggregate crushers and heavy drill rigs at midnight or on Sunday mornings
in close proximity to residential zones.
    - _Regulatory Abdication: _
The DMRE Mine Health & Safety Inspectorate and
City of Tshwane Environmental Health have repeatedly failed to issue compliance
notices despite numerous formal complaints, necessitating escalation directly
      to the Presidency.
