Government has recently introduced the Legal Practice Act which aims to increase your access to justice by ordering the profession to redesign and diversify, and to adopt norms and standards with objectivity and accountability.

But, some of the most important sections of the Legal Practice Act are not yet operational, most notably;

  • the duty of lawyers to provide fee estimates to clients in advance.
  • the duty of lawyers to inform clients in advance as to chances of success
  • the duty of lawyers to explain, in advance, the details of the legal process.

You are invited to help increase access to justice to all by telling us which of these duties are important and which should be implemented first.

SUMMARY

DearSA has partnered with Argumentum LPM, a legal project management firm which assist in the scoping and budgeting of legal projects, to compile the results of this survey. The report will be handed to the South African Legal Practice Council, the Minister of Justice and the Parliamentary Portfolio Committee on Justice to convince them to prioritise implementation of the remainder of the Act, as informed by your views.
